Who needs a property dealer licence in Haryana?
The Haryana Regulation of Property Dealers and Consultants Act, 2008 regulates commission-based property dealing. Sections 2 and 3 cover brokers, consultants and estate agents arranging property transactions, including their representatives and employees acting in that business.
The scope includes sale, purchase, exchange, letting, taking on lease and rent collection in relation to immovable property. It extends beyond a particular builder’s project. Explain the work you actually do, who contracts with clients and who receives the commission when seeking an application review.
Flats, houses and plots
Brokerage involving resale homes, residential plots and commercial premises falls within the activities to assess under the Act. Record the actual business entity behind your trading name.
Agricultural and other land
The Act’s definition of immovable property includes land. A dealer licence does not establish that a particular land use, subdivision, colony or proposed transfer is lawful; those checks remain part of the transaction.
Rental and leasing brokerage
Letting and leasing are within the licensing framework. A business dealing only in rental property should still assess its obligations under the 2008 Act.

Who can apply?
Rule 3 sets eligibility conditions for individuals and entities. An individual must have attained 21 years; residence, business premises and solvency particulars matter. Serving Central or State Government and public sector employees are excluded. Have any concern about eligibility, business constitution or the proposed signatory reviewed before filing.
Property dealer licence fees in Haryana
The 2 November 2017 amendment to Rule 5 substituted ₹2,000 for the licence and renewal fees in both listed categories. Use that amended schedule when checking an assessment, and confirm the amount currently demanded by the receiving authority before payment.

Why older fee tables differ
The original schedule used ₹25,000 / ₹50,000 for grant and ₹5,000 / ₹10,000 for renewal. Those are the figures replaced by the 2017 amendment. A screenshot of the original Rules should therefore be read with the amendment.

Documents for property dealer registration in Gurgaon
Rule 4 identifies the supporting material for grant or renewal. Use the current district application format and obtain the receiving office’s instructions for signatures, attestations and verification.

Guarantors and police verification
The dealer Rules refer to two guarantors and a character certificate. Confirm with the district office who may stand as guarantor, which evidence is accepted and how any police or character verification is arranged. Those details should be resolved before the file is submitted.
The Collector’s licence. A district application.
Section 4 places grant and renewal applications before the Collector. For Gurgaon, check the current submission arrangements with the district administration’s revenue branch or District Revenue Officer.
Rule 4 connects the application to the jurisdiction where the applicant resides or has an office. Give Nisha the actual residence and business addresses so the appropriate office and any discrepancy can be identified.

How the property dealer licence application proceeds
Identify the applicant
Confirm the individual or entity conducting the brokerage business. Review the proposed name, eligibility, office location and whether this is a new application or renewal.
Prepare Form A and annexures
Bring the form, photographs, address records, declarations, character material and guarantor details together. Resolve mismatched names or incomplete records before submission.
Confirm payment and submission
Check the amended fee schedule, the current challan/payment route and the office or service channel receiving the application. Retain the payment receipt and acknowledgement.
Complete verification and scrutiny
Respond to document queries and any verification requested by the authority. Keep a copy of each response and record which original documents were produced.
Review the decision
On approval, check the Form B certificate’s name, number, dates and conditions. If a deficiency or rejection is communicated, have the reasons reviewed before choosing the next step.
Set up ongoing records
Maintain the required transaction register, display the licence number and calendar renewal. Preserve agreements and commission receipts in an organised business record.
The sequence combines the Rules’ application and scrutiny framework with practical file-management guidance. Processing depends on completeness, verification and the authority’s decision; an approval date cannot be fixed in advance.
Form B, five-year validity and renewal
Rule 7 provides for a licence in Form B for five years, renewable for further five-year periods. Form A is used for a renewal application too. Work from the dates printed on your certificate and prepare the updated file before it expires.
Tell Nisha about changes to the business name, address, partners or company details. Include any pending complaint or authority notice that may affect the application.
Already expired or difficult to verify?
Share the old certificate, last renewal and communications received. The appropriate route and any late fee require review; an old licence number alone does not prove a current entitlement to operate.

The 1% commission rule and Form D register
Licensing brings ongoing responsibilities. The remuneration recorded in a brokerage agreement and receipt should follow the applicable Rules, and the transaction should be supported by a proper documentary record.
1% combined commission
Rule 10 specifies 1% of the agreed consideration in total: 0.5% from the seller and 0.5% from the purchaser, on finalisation of the deal as recorded in the dealer’s register and supported by a valid receipt.
One month’s rent
For lease or rent transactions, Rule 10 specifies commission at the rate of one month’s rent, payable by the lessor and lessee. Have the proposed allocation and payment terms checked before recording or collecting brokerage.
Maintain Form D
Keep the prescribed transaction register in Form D, display the registered licence number at the office and retain the supporting agreements and commission records. Records should be available for authorised inspection.

Illustrative sale calculation: at an agreed consideration of ₹1 crore, 1% is ₹1 lakh in total—₹50,000 from each side under the split stated in Rule 10. Review the transaction documents and any applicable tax treatment separately.
Penalties and financial liability
The published Section 17(2) text provides a base penalty of ₹50,000 for an individual and ₹1,00,000 for a society, company or organisation carrying on property dealing without a valid licence. It also addresses repayment of benefits received and losses suffered by an affected party.
The 2025 Jan Vishwas Ordinance’s replacement text preserves those base amounts and provides for enhanced penalties for subsequent violations. The applicable enactment, date of conduct and procedure must be checked together when responding to a notice. A later application does not automatically resolve an earlier violation.
