How to transfer property to a family member in Gurgaon
Register a Blood Relation transfer deed (family relation) at the Sub-Registrar office that covers the property. When the property goes to the owner’s son, daughter, father, mother, grandchild, brother, sister, husband or wife, stamp duty is ₹0 under Haryana’s order of 16 June 2014. The government dues are a ₹100 registration fee and a ₹500 token — ₹600 in all. The parties and two witnesses attend the office once, on the appointment day, and the whole process takes 3 to 5 days from complete papers.
Lawyers in Gurgaon (lawyersingurgaon.in) handles the complete file for ₹10,000, which includes the ₹600: title and relationship check, deed drafted by Advocate Sunita Tiwari (Bar enrolment P-839A/2009), paperless filing, appointment and registration in Gurugram.

Who are you transferring the property to?
Choose the closest family situation for your Gurgaon property. The owner’s share, the proposed recipient and whether ownership should change now or after death determine the appropriate route.
Property transfer to a son
A father or mother can transfer property or a share they legally own to a son. Identify the exact interest and record any intended right to remain in the home or receive rent. Joint or ancestral ownership needs separate review.
Free consultation: parent-to-son transferProperty transfer to a daughter
A father or mother can transfer property or a share they legally own to a daughter. Record the exact interest and agreed possession terms. Marriage does not remove her status as the owner’s daughter for the notified relationship category.
Free consultation: transfer to a daughterTransfer between husband and wife
Adding a spouse to ownership, transferring the whole property and transferring one joint owner’s share are different instructions. Identify the percentage being transferred and check the home loan before preparing the deed.
Free consultation: spouse transferTransfer between siblings
A brother or sister may be receiving a new interest, or may already own part of the property. That distinction helps determine whether a transfer, gift or release is suitable. The deed should reflect the existing ownership accurately.
Free consultation: sibling transferProperty transfer to a grandchild
For a grandparent’s transfer, establish the family connection across both generations. Haryana’s clarification includes grandchildren through sons and daughters. A transfer to a minor also needs careful planning for acceptance, representation and management.
Free consultation: grandchild transferAn inherited family share
Where the recorded owner has died, first establish succession and each heir’s interest. An heir may then be able to release an existing share in favour of an appropriate co-owner. Outstanding disputes and missing title records need attention before registration.
Free consultation: inherited share Property transfer after an owner’s deathA person can deal only with the interest they are legally entitled to transfer. Joint ownership and ancestral or disputed family property need a review of everyone’s rights.
Family Property Registration Process in Gurgaon
The usual route is to check ownership, prepare the appropriate deed, complete the current Haryana online-file and appointment stages, and attend the required registration formalities. The property and instrument determine the exact requirements.
Check ownership & relationship
Review the existing deed, recorded owners and exact share. Identify the recipient, relationship proof and any inheritance, mortgage, restriction or title issue.
Draft & approve the deed
Choose the instrument and record the property, transferred share, possession and agreed family terms. Review and approve the draft before the registration file proceeds.
Prepare the online file
Complete the applicable Haryana e-registration entries, supporting uploads and payment steps. Check the relationship evidence and the dues for the selected instrument.
Clear queries & book the visit
Address any scrutiny query and coordinate clearance and an available appointment under the current portal procedure. Confirm the office, date, documents and attendance arrangements.
Complete registration formalities
Attend as required with accepted identification, original papers and witnesses. Complete the applicable execution, identity, biometric and presentation formalities before the registering officer.
Receive the deed & check records
Obtain the registered document and check the relevant record update. Where auto-mutation applies, track the revenue entry; municipal, authority, society or lender records may need further action.
Can you start online? Yes. The enquiry, draft discussion and document preparation can begin remotely. Paperless filing does not itself remove the applicable attendance, identity and execution requirements. Any representative or power-of-attorney arrangement is assessed before booking.
Your registration office and schedule: the Gurgaon property’s location and current jurisdiction guide office selection. The expected drafting, scrutiny and appointment schedule is confirmed after the file is reviewed. Mention any preferred date, travel plan or attendance difficulty at the start.

Which deed fits your family arrangement?
“Family property transfer” describes the goal. A transfer deed, gift, release, settlement or Will can have different effects. The document should match what your family actually intends.
For a closer look at the documents, compare gift deeds, transfer deeds and relinquishment options in Haryana.
Transfer or gift during life
An owner wants a family member to receive ownership now. The title, relationship, terms and actual transaction determine the instrument and any duty remission.
Transfer deed registration in Gurgaon and HaryanaGift without payment
A voluntary transfer without consideration may use a gift deed. Acceptance and applicable execution and registration requirements need to be addressed.
Gift deed registrationRelease an existing share
An heir or co-owner gives up a right they already hold. First establish those rights and the recipient’s entitlement; a release is not suitable for every family transfer.
Release / relinquishment serviceSettle family rights
Several family members want to arrange or resolve rights or claims. The legal effect of a family settlement, and the document needed to record it, require individual review.
Free family settlement consultationKeep ownership during life
If the intention is for the beneficiary to inherit after death while the owner retains control during life, discuss a Will and how it fits the family’s circumstances.
Will drafting and registrationTransfer for a price
Where the arrangement is a genuine sale, payment and sale-deed requirements must be addressed. A family relationship alone does not turn a sale into a duty-free gift.
Property registration assistanceWhere special personal-law rules or an earlier family arrangement may apply, mention them during review. Renaming a document does not change the substance of the transaction.

Family Property Transfer in Gurgaon: FAQs
How can I transfer property to a family member in Gurgaon?
Register a transfer deed (family relation) at the Sub-Registrar office that covers the property; for the owner’s parents, children, grandchildren, siblings and spouse, stamp duty is ₹0 and the government dues are ₹600. Review the owner’s title and exact share, choose the appropriate deed, establish the relationship and prepare the draft. Complete the current Haryana online-file, payment and appointment steps, then the required formalities before the concerned Sub-Registrar. After registration, check the registered document and the relevant property-record update.
What government dues are included in the quoted package?
For the eligible family-transfer case quoted here, stamp duty is ₹0, the registration fee is ₹100 and the token charge is ₹500: ₹600 in total. This amount is already included in the ₹10,000 package. The relationship, instrument and applicable dues are checked for the file before payment; other transaction types can have different charges.
What does the ₹10,000 family-transfer package cover?
₹7,500 professional fee plus ₹2,500 registration-related, which includes the ₹600 government dues. For the eligible Gurgaon family-transfer case, the package covers review of supplied title papers, deed selection, relationship and remission checks, drafting, registration preparation, coordination and guidance on the next record update. The ₹100 registration fee and ₹500 token are included in the package. Additional authority, society or bank charges, a full title-search report, litigation and mutation filing are separate unless agreed. Other transaction types are quoted after review.
What documents are needed for family property transfer in Gurgaon?
Start with the existing title deed, the parties’ identity and address papers, PAN where required, the relevant property ID or land records, relationship proof and witness documents. Inherited, mortgaged or represented cases need additional succession, lender or power-of-attorney papers. The final checklist depends on the instrument and property. Property inside municipal limits also needs a No Dues Certificate from the Haryana property-tax portal (Section 96A, Haryana Municipal Corporation Act, 1994).
Can I start the process online if I live outside Gurgaon?
Yes. The enquiry, draft discussion and document preparation can begin remotely. Online filing does not itself remove the applicable attendance, identity, biometric and execution requirements. Any lawful representative or power-of-attorney arrangement is assessed before the appointment. Confirm the arrangements before booking travel. A party who cannot attend can act through an attorney holding a valid power of attorney; one signed abroad must be attested at an Indian Embassy or Consulate (or apostilled) and stamped in Haryana within three months of reaching India.
How long does family property registration take in Gurgaon?
It takes 3 to 5 days from complete papers to the registered deed. The schedule is confirmed after reviewing the title papers, chosen instrument, supporting documents and any permissions. It includes drafting, online-file scrutiny or clearance, an available registration appointment and release of the registered document. Share a preferred date early; office queries, missing papers or appointment availability can affect the plan.
Can a father or mother transfer a flat to a son or daughter?
Yes — and because children are listed relatives, stamp duty is ₹0 and the government dues are ₹600. A parent can generally transfer property or a share that the parent legally owns, subject to applicable restrictions. The deed should identify the recipient, the exact interest transferred and any agreed terms about possession or occupation. Joint ownership, ancestral rights and a home loan require separate checks.
Is stamp duty zero for every transfer within a family?
No. Haryana’s remission applies to qualifying lifetime property-transfer instruments in favour of the relations listed in its notification. The government clarification identifies parents, children, grandchildren, siblings and spouse. Cousins and in-laws are not automatically included. Stamp duty, registration fees and other charges must be considered separately. The list comes from Haryana’s Order No. S.O. 62/C.A. 2/1899/S.9/2014 dated 16 June 2014; a corrigendum of 24 July 2026 confirmed that a daughter’s children qualify too.
Can one legal heir give their share to another family member?
Yes, by a registered relinquishment (release) deed in favour of a co-heir, once succession is established. First establish the deceased owner’s succession position and the share held by each heir. A release or relinquishment may be suitable where an existing entitlement is being given up in favour of an appropriate co-owner or heir. One person cannot release somebody else’s share. If the recipient does not already hold the relevant entitlement, another instrument may be required.
Can I transfer ownership and continue living in the property?
Yes. The deed can reserve your right to live in the property and collect its rent for life; the Supreme Court upheld such a reservation in Renikuntla Rajamma v. K. Sarwanamma (2014). A parent aged 60 or over can also make the transfer conditional on the child providing care: under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the Maintenance Tribunal can declare the transfer void if the child fails, and courts have refused that relief where the condition was not written into the deed. Discuss the intended right of residence, use, rent and maintenance before signing. These matters may need express clauses and a suitable legal structure. If the intention is to keep ownership and control throughout life, a Will may be more appropriate. A completed transfer should not be treated as something that can automatically be cancelled later.
Is a family transfer deed the same as a family settlement?
Not necessarily. A family transfer may move an owner’s property to a relative. A family settlement concerns the arrangement or resolution of family rights or claims. Whether a settlement document itself creates or changes rights, or only records a completed arrangement, can affect its registration and stamp treatment. The facts and document need individual review.
Is the initial family property transfer consultation free?
Yes. Your initial discussion with Advocate Sunita Tiwari is free by phone or WhatsApp. Explain your intended family arrangement and discuss useful documents, the registration process, expected charges and the next step. Detailed document review, a title-search report, drafting and registration assistance are paid services with an agreed scope. Start your free initial consultation on WhatsApp or call 87960 21579.
Does registration automatically change every property record?
Partly. Since 23 June 2026, Haryana’s Auto Mutation System starts the revenue-record mutation from the registration itself, with no separate application. Haryana’s auto-mutation system can initiate the revenue-record update for transactions covered by that process. Check the resulting entry and its status. Municipal, authority, society and lender records can have separate update requirements. This package includes guidance; additional applications or follow-up are undertaken only where agreed.
Is a transfer to a daughter-in-law, son-in-law, nephew or cousin free of stamp duty?
No. They are not in Haryana’s 2014 order, so normal stamp duty applies on the collector-rate value: inside Gurugram municipal limits, 7% for a male recipient, 5% for a female recipient and 6% for a man and woman jointly; outside municipal limits, 5%, 3% and 4%. A CAG audit published in 2026 found 21 Haryana transfer deeds wrongly given the ₹0 remission for people outside the listed relations.
Who drafts and registers the deed?
Advocate Sunita Tiwari, an independent practising advocate (Bar enrolment P-839A/2009) handling property registration in Gurugram since 2009. Her chamber is No. 153, 2nd Floor, Block C, District and Sessions Court, Gurugram. Lawyers in Gurgaon (lawyersingurgaon.in) coordinates the enquiry, papers and appointment.
Is a No Dues Certificate (NDC) required?
Yes, for property inside municipal limits. Section 96A of the Haryana Municipal Corporation Act, 1994 (Section 99A of the Haryana Municipal Act, 1973 for councils and committees) requires an NDC before the covered transaction. Check the property ID, tax-payment status and certificate through the Haryana property-tax portal as part of preparing the registration file.
