Why an unregistered agreement can let you down

Under the Registration Act, 1908, a lease of immovable property from year to year, for a term exceeding one year, or reserving a yearly rent, generally requires compulsory registration. This is why the market defaults to 11-month agreements — they sit outside that requirement.

The consequence matters. A document that required registration but was not registered may not be received in evidence of the transaction affecting the property, subject to the recognised exceptions. If your tenancy is genuinely long or the deposit is substantial, that is a risk worth removing rather than assuming away.
