How to File a RERA Complaint in Gurgaon
The process, fees and documents for taking a builder dispute to HRERA.
To file a RERA case in Gurgaon, identify the correct forum, prepare your complaint and complete the online and physical filing requirements. Use this guide to check the official fees, documents and service steps before submission.
How do you file a RERA complaint in Gurgaon?
Choose the appropriate HRERA Gurugram complaint route, prepare the prescribed complaint and supporting documents, register it on the official portal, pay the applicable fee, serve the respondent and complete the required physical and soft-copy submission. Retain the complaint number and track scrutiny, notices and hearings. The published Gurugram process includes physical filing after online registration. [2]
Start with maintainability
Who can file a RERA case in Gurgaon?
Section 31 of the Real Estate (Regulation and Development) Act, 2016 allows an aggrieved person to complain about a violation of the Act, rules or regulations before the appropriate Authority or Adjudicating Officer. The provision also recognises an association of allottees or a registered voluntary consumer association. [6]
For a homebuyer, the issue may involve delayed possession, refund refusal, disputed charges, missing amenities, defective construction or another failure connected with the promoter’s obligations. The agreement, project position, evidence and relief requested determine whether the proposed complaint is maintainable.
Check the project’s location first. Haryana has a separate authority for Gurugram district and another for the rest of the state. A Delhi address or overseas residence does not, by itself, change the forum for a project in Gurugram. [1]
Build the evidence file
Documents required for a RERA complaint in Gurgaon
Organise readable copies before starting the portal process. Not every case requires every document below; the complaint should include the records relevant to the allegations and relief. Use the same names, unit description, dates and amounts throughout.
- Booking and allotment recordsBooking form, application, allotment letter, unit number, project phase and payment plan.
- Builder-buyer agreementComplete signed agreement, schedules, amendments and the clauses governing possession, cancellation and charges.
- Payment proofReceipts, bank transfers, relevant statements, demand letters and a reconciled summary of amounts paid.
- Possession and project recordsPossession offer, occupation/completion certificate information, available approvals and RERA registration details.
- Correspondence and assurancesEmails, notices, refund requests, replies and complete relevant WhatsApp exchanges with dates.
- Evidence of defects or changed promisesPhotographs, inspection records, snag lists, specifications, brochures and relevant advertisements.
- Parties and representation detailsCorrect complainant and respondent names, service addresses, email/mobile details and authorisation where applicable.
- Earlier proceedings and ordersExisting complaints, pleadings, settlement or waiver documents, orders, execution papers and any appeal or stay.
Prepare a one-page chronology
Record the booking date, agreement date, contractual possession date, payments, later promises, actual possession offer and the grievance that remains. Link each important event to an annexure and page number. The Gurugram regulations expressly call for a list of dates and a serially numbered complaint file. [4]
From preparation to submission
How to file a RERA complaint in Gurgaon: step by step
The following sequence is based on the filing instructions linked from the official HRERA Gurugram portal. Check current notices and registry directions before making payment or delivering the papers.
Confirm the project, respondent and relief
Check the project’s exact location, registration or coverage position, phase and promoter. The entity named in the agreement and receipts may differ from the trading name used in advertisements. Identify the correct respondent and usable service details.
Then decide what you are asking for: possession-related directions, delay interest, withdrawal and refund, rectification or separately maintainable compensation. For a Delhi resident with a Gurugram flat, the property’s location remains central to the authority check.
Draft the complaint and index the annexures
Prepare a clear chronology, concise facts, the questions requiring decision and the exact relief requested. Refer to the relevant agreement clauses and statutory provisions where applicable. Explain the calculation and period of any monetary claim.
Use the prescribed format and relevant Gurugram form. The 2018 complaint regulations organise the file into an index, registration printout, list of dates, facts, issues, relief and affidavit. Number the file and ensure each cited annexure is attached. [4]
Check the current forms on the official downloads page. The linked Gurugram CRA download is labelled for refund claims, so select or confirm the form appropriate to your own relief. [5]
Register the complaint on the official portal
Open the HRERA Gurugram portal and locate Complaint Registration. Choose the route for a complaint with the Authority or with the Adjudicating Officer, as appropriate.
Complete the information requested about the complainant, respondent, project and grievance, and follow the system’s prompts. Use an email address and mobile number that will remain accessible for case communication.
The published steps say that submission generates an online complaint number. Save the registration form / Proforma B and that number for future correspondence. [2]
Pay the applicable complaint fee
The official Gurugram registration sheet lists ₹1,000 per complaint plus ₹10 per annexure. It refers to a demand draft in favour of Haryana Real Estate Regulatory Authority Gurugram, payable at Gurugram, or an online payment gateway. Follow the payment option and current instructions applicable to your filing. [2]
Retain the actual payment acknowledgement or demand draft, as applicable, and place the required proof in the filing set. The fee table below separates official charges from professional fees.
Send the complaint to the respondent and preserve service proof
The Gurugram filing sheet calls for a self-signed copy of the complaint to be sent directly to the respondent through speed post and email, with a signed declaration of service. After delivery, attach the postal tracking and email report as evidence. [2]
Check each respondent’s name and address carefully. A postal receipt alone may not show the final delivery position; preserve the tracking record as well as the email and its attachments.
Complaint service and a legal notice are different steps. Section 31 does not impose a universal legal-notice prerequisite. Assess any contractual or case-specific requirement, while still completing the service formalities applicable to the complaint.
Complete physical filing and the soft-copy requirements
Assemble the registration printout / Proforma B, detailed typed complaint, affidavit, indexed annexures, applicable fee instrument or proof, and signed service declaration with supporting records. Complete the filing in the format and number of sets required by the registry.
The official steps also ask for the complaint in Word format, the complete complaint with annexures in PDF format, and respondent contact details on legal paper. The sheet says copies should be submitted to the HRERA office within 30 days. [2]
Confirm the number of paper sets before printing. The portal’s steps sheet says one set plus the number of respondents, while regulation 8 of the 2018 regulations refers to quadruplicate plus respondent copies. These published materials differ. Check the current requirement with the filing branch and follow the applicable registry direction. [2] [4]
Do not treat an online complaint number as confirmation that all filing formalities are complete. Retain the registry acknowledgement and any defect communication.
Track scrutiny, cure defects and attend the proceedings
Check the complaint status and your registered contact channels. A file with missing annexures, unreadable papers, an incorrect format or unpaid fees may be returned for correction. The 2018 regulations refer to rectification of notified deficiencies within 15 days; comply with the deadline stated in the applicable notice. [4]
Once the matter proceeds, track the cause list, service, replies, hearing directions and orders. Prepare your response to the builder’s defence using the agreement, payment record and evidence already filed.
If the final order is not complied with, assess the separate enforcement or execution step, including whether an appeal or stay affects it. [6]
Official charges and professional fees
RERA complaint filing fees in Gurgaon
The following amounts are taken from the published Gurugram registration steps and Schedule III of the Haryana RERA Rules, 2017. They are official filing charges, separate from an advocate’s quotation. [2] [3]
| Fee item | Published amount | What to check |
|---|---|---|
| Authority complaint | ₹1,000 | Basic complaint filing fee; confirm the route and current payment instructions. |
| Each annexure | ₹10 | The published wording is per annexure. Confirm the registry’s calculation for your indexed file. |
| Each additional affidavit | ₹20 | Listed separately in Schedule III, where applicable. |
| Amended complaint | Separate ₹1,000 | Schedule III specifies a separate fee for an amended complaint. |
| Advocate and preparation costs | As agreed | Review, drafting, filing assistance, hearings, printing, postage and further proceedings may have separate charges. |
Example: A complaint with eight annexures gives ₹1,000 + (8 × ₹10) = ₹1,080 in listed complaint and annexure charges. This example excludes additional affidavits, amendments, professional fees and other applicable costs.
Confirm the amount accepted for the particular filing before payment. The figures above do not represent a fixed all-inclusive price for conducting a RERA case.
Forms and pleadings
RERA complaint format: CRA, CAO and Proforma B
Proforma B records complaint-registration information. It does not replace the detailed complaint and evidence file required by the published Gurugram procedure.
Form CRA is referred to in rule 28 for complaints before the Authority. The official downloads page distinguishes the Gurugram CRA form from the Panchkula form; its linked Gurugram download is labelled for refund claims.
Form CAO is referred to in rule 29 for the Adjudicating Officer route and is included in the published rules. Apply the current legal distinction between refund / delay-interest relief and compensation when selecting the route. [3] [5] [7]

Status, hearings and compliance
What happens after an HRERA complaint is filed?
The case moves through scrutiny and the applicable hearing process. Filing completeness, service, the issues raised and case-specific directions affect the sequence.
Registry review
The papers are checked for format, legibility, annexures and fees. Attend to a defect notice promptly and preserve the corrected filing acknowledgement.
Notice and reply
The respondent’s reply may dispute dates, payments, liability or relief. Review the defence against the agreement and documents, and comply with directions for further submissions.
Hearings and order
Attend the listed dates in person or through authorised representation. Read the operative order carefully, including compliance periods and any conditions.
How to check RERA complaint status
Use the official complaint-status search and keep the required complaint details ready. Check the relevant cause list and uploaded orders as well; do not rely only on a message from the other side.
Official complaint-status search ↗How long will the RERA case take?
Sections 29(4) and 71(2) contain 60-day disposal provisions, with reasons to be recorded where disposal takes longer. Actual proceedings and any later recovery can take longer; a guaranteed payment or completion date cannot be inferred from those provisions. [6]
For non-compliance with an order, assess enforcement under the applicable framework, including section 40 and any appeal or stay. A successful order and actual recovery are separate stages.
A final file check
Common mistakes when filing a RERA case
A precise file helps the registry and the forum understand who is complaining, what happened, which documents support it and what relief is requested.
Choosing the wrong route
Check Gurugram versus Panchkula and the Authority versus Adjudicating Officer distinction before registering the claim.
Naming the wrong entity
Match the promoter / respondent details with the agreement and project records. Include accurate addresses and contact particulars.
Leaving relief unclear
Explain whether you want withdrawal, possession, delay interest or another remedy. Support calculations, dates and legal grounds.
Stopping at online registration
Complete the service, physical submission and soft-copy formalities required for the filing. Keep the acknowledgement and service records.
Filing an inconsistent record
Reconcile receipts and amounts paid. Include complete relevant communications and ensure the index points to the correct pages.
Omitting earlier proceedings
Disclose earlier cases, settlements, waivers, orders, appeals and stays. Their effect on the proposed relief needs review.

Questions before filing
RERA complaint Gurgaon: FAQs
Answers about the filing process, charges, representation and the steps after online registration.
How do I file a RERA case in Gurgaon?
Start on the official HRERA Gurugram portal, select the appropriate complaint-registration route, complete the registration details and retain the online complaint number. Prepare the prescribed complaint with indexed annexures, pay the applicable fee, serve the respondent and complete the physical and soft-copy requirements. The published Gurugram steps include physical submission; obtaining an online number alone does not complete every filing requirement.
What is the RERA complaint filing fee in Gurgaon?
The published Gurugram registration sheet and Schedule III of the Haryana RERA Rules list a complaint fee of ₹1,000 plus ₹10 for each annexure. Schedule III also lists ₹20 for each additional affidavit and a separate ₹1,000 for an amended complaint. Professional fees and document-preparation costs are separate. Confirm the applicable amount and payment method with the registry when filing.
Can I file an HRERA Gurgaon complaint completely online?
Do not assume that online registration completes the filing. The official Gurugram steps also call for physical complaint sets, service proof and soft copies. That sheet says the copies should reach the HRERA office within 30 days. Follow any current registry directions that apply to your matter.
Which form is used for a RERA complaint in Gurugram?
Rule 28 refers to Form CRA for an Authority complaint. The official downloads page has a Gurugram-specific CRA form, whose linked download is labelled for refund claims. Rule 29 refers to Form CAO for the Adjudicating Officer route. Use the current form appropriate to the relief sought and apply the Authority / Adjudicating Officer distinction explained in Newtech; the labels in an older form should not determine jurisdiction by themselves.
Is a lawyer compulsory for filing a RERA complaint?
No. Section 56 of the RERA Act permits appearance in person as well as authorised representation. An advocate can assist with jurisdiction, the relief claimed, calculations, documents, replies and hearings. The complainant must still comply with the applicable filing and procedural requirements.
Is a legal notice mandatory before an HRERA complaint?
Section 31 does not prescribe a legal notice as a universal precondition to every RERA complaint. Contractual terms, the relief and case-specific directions still need review. The Gurugram filing sheet separately requires sending the complaint to the respondent by speed post and email and supplying service proof; this is different from a pre-filing legal notice.
Can I seek both a refund and compensation through RERA?
Refund, interest on the refund and interest for delayed possession are matters for the Authority under the distinction explained in Newtech. Adjudging compensation under sections 12, 14, 18 and 19 falls within the Adjudicating Officer’s jurisdiction under section 71. Where both types of relief are sought, the forum and pleadings need to be structured correctly; compensation is not automatic.
Can a Delhi resident or an NRI file for a Gurgaon property?
Yes, subject to maintainability and the project falling within the relevant jurisdiction. The project’s location is important; the buyer’s residence in Delhi, another state or overseas does not by itself move a Gurugram project complaint to Delhi RERA or Panchkula. Representation, signatures, service details and any authorisation requirements should be checked for the particular case.
Can I complain if the project does not appear in the RERA project search?
The absence of a project from a search result does not by itself decide whether a complaint is maintainable. Check the correct project name and phase, the registration position, whether registration was legally required, any exemption and the grievance. A project’s coverage and the appropriate route need a fact-specific assessment.
How long does an HRERA Gurugram case take?
Sections 29(4) and 71(2) contain 60-day disposal provisions for the Authority and compensation adjudication respectively, with written reasons required where disposal takes longer. They should not be presented as a promise that every case, payment or enforcement process will finish in 60 days. Defects, service, pleadings, hearing schedules, stays and later execution can affect the actual time.
How can I check my HRERA complaint status?
Use the complaint-status search linked from the official HRERA Gurugram portal and enter the complaint details requested. Also check the relevant cause list and orders. Keep the online complaint number, registered case details, filing receipts, registered email and mobile number available.
What if the builder does not comply with the RERA order?
Review the operative directions, compliance period, payment or possession position and any appeal or stay. Enforcement or execution under the applicable RERA framework may be required. An order in the buyer’s favour does not by itself establish that the money has been recovered or possession delivered.
