The government clarification covers parents, children, grandchildren, siblings and spouse, including grandchildren through a daughter. It does not create a blanket exemption for every relative or every family transaction.

How can I transfer property to a family member in Gurgaon?

Is a family transfer deed the same as a family settlement?

Not necessarily. A family transfer may move an owner’s property to a relative. A family settlement concerns the arrangement or resolution of family rights or claims. Whether a settlement document itself creates or changes rights, or only records a completed arrangement, can affect its registration and stamp treatment. The facts and document need individual review.

Can a father or mother transfer a flat to a son or daughter?

A parent can generally transfer property or a share that the parent legally owns, subject to applicable restrictions. The deed should identify the recipient, the exact interest transferred and any agreed terms about possession or occupation. Joint ownership, ancestral rights and a home loan require separate checks.

Is stamp duty zero for every transfer within a family?

No. Haryana’s remission applies to qualifying lifetime property-transfer instruments in favour of the relations listed in its notification. The government clarification identifies parents, children, grandchildren, siblings and spouse. Cousins and in-laws are not automatically included. Stamp duty, registration fees and other charges must be considered separately.

What does the ₹10,000 family-transfer package cover?

For the eligible Gurgaon family-transfer case, the package covers review of supplied title papers, deed selection, relationship and remission checks, drafting, registration preparation, coordination and guidance on the next record update. The ₹100 registration fee and ₹500 token are included in the package. Additional authority, society or bank charges, a full title-search report, litigation and mutation filing are separate unless agreed. Other transaction types are quoted after review.

Can one legal heir give their share to another family member?

First establish the deceased owner’s succession position and the share held by each heir. A release or relinquishment may be suitable where an existing entitlement is being given up in favour of an appropriate co-owner or heir. One person cannot release somebody else’s share. If the recipient does not already hold the relevant entitlement, another instrument may be required.

Can I transfer ownership and continue living in the property?

Discuss the intended right of residence, use, rent and maintenance before signing. These matters may need express clauses and a suitable legal structure. If the intention is to keep ownership and control throughout life, a Will may be more appropriate. A completed transfer should not be treated as something that can automatically be cancelled later.

Can I start the process online if I live outside Gurgaon?
