Can Parents Cancel a Gift or Transfer Deed in Haryana?

A family transfer should reflect how parents want to live, receive care and pass on their property. A Bombay High Court case offers a useful starting point for families considering a transfer in Gurgaon and across Haryana.

The short answer

Yes, a qualifying transfer by a senior citizen can be set aside when its maintenance condition is breached. The Tribunal must examine the legal requirements, the documents and the evidence. The case behind the news

Parents gifted their flat, but the promise of care failed

In Ashwin Ramesh Soni v. Ramesh Bachaulal Soni & Others, the parents had gifted their Lower Parel flat to their son. The registered deed dated 8 May 2023 expressly required him to care for them. The relationship subsequently deteriorated, and the parents had to leave their home.

The Maintenance Tribunal declared the gift deed concerning the Yashashree flat void and directed restoration of possession. The Bombay High Court dismissed the son’s challenge and required compliance with the Tribunal’s directions. It also rejected the argument that the parents’ financial independence prevented relief once the requirements of Section 23 were met.

The Times of India report dated 5 September 2026 also discusses possible future inheritance. That is a separate succession question: the judgment did not award the son a future share.

The legal framework

What does Section 23 require?

Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 addresses property transferred by a senior citizen after the Act’s commencement. Its two central requirements are:

  1. A condition of care: the transfer was subject to the recipient providing the transferor’s basic amenities and physical needs.
  2. A failure to fulfil that condition: the recipient refuses or fails to provide those amenities and needs.

When the requirements are established, the Tribunal can declare the transfer void at the transferor’s option. The provision covers property transferred through a gift or another form of transfer, so it can be relevant to family transfer and release deeds too. The instrument’s name alone does not decide the claim.

Sudesh Chhikara v. Ramti Devi

This case involved a release deed concerning property in Basai, Gurugram. The Supreme Court set aside cancellation where the required maintenance condition had not even been pleaded and no corresponding finding had been recorded. A transfer motivated by love and affection does not, by itself, establish that condition.

Babli Rani v. District Magistrate, Rohtak

The High Court reversed cancellation where the necessary condition and supporting case had not been established. It also explained that an absent recital in the deed would not itself defeat the senior citizen’s case if the condition was alleged in the application and proved through evidence.

Practical drafting lesson: record the intended care arrangement clearly when the transfer is made, preserve supporting documents and keep evidence of subsequent events. Relying on an unwritten understanding can make the dispute harder to establish.

How should parents plan a family transfer?

Before transferring a flat, house, plot or share in land, discuss the intended arrangement in practical terms. These are useful questions to resolve with the advocate drafting the deed:

Any retained rights or revocation terms need a legally workable structure. For example, a gift cannot simply be made revocable whenever the donor changes their mind: Section 126 of the Transfer of Property Act places limits on revocation. Read Section 126.

If the property has already been transferred

Prepare the documents and a clear timeline

Start with a complete record of the transaction and what happened afterwards. For a review of possible remedies, gather:

  • The registered deed and title records: include the full deed, registration particulars, earlier ownership documents and relevant property or revenue records.
  • The care arrangement: provide any undertaking, correspondence or other contemporaneous material showing the agreed obligations.
  • Evidence of events: organise relevant messages, requests for support, medical expenses, payments, complaints and witness details by date.
  • Other proceedings and transactions: disclose earlier suits, Tribunal orders, mortgages or subsequent transfers so their effect can be assessed.

Relief under Section 23 is sought before the competent Maintenance Tribunal. Haryana has a notified tribunal framework under its 2009 Rules; jurisdiction and the current tribunal arrangements should be confirmed for the particular matter. Haryana Government’s tribunal information.

The application needs to connect the alleged care condition with the actual failure and the relief sought. A disputed transfer should be reviewed before attempting cancellation through a fresh document; Section 126 also limits when a gift may be revoked. Revocation provisions.

The separate inheritance question

Can the same child still inherit the property later?

Potentially, yes. Cancellation of a gift for breach of a care condition does not, by itself, create an automatic disqualification from inheritance under the Hindu Succession Act. Succession depends on the applicable law and the circumstances when the owner dies. Hindu Succession Act, including Section 28.

For example, if a Hindu father retains his separate property and dies without a valid Will covering it, his son may inherit alongside other eligible heirs. A valid Will can direct the distribution of property that the parent is legally entitled to dispose of. Joint ownership requires each owner’s share and estate to be considered separately. Common questions

Two points worth clarifying

Is a claim impossible if the deed has no maintenance clause?

No blanket answer is safe. The actual condition, supporting documents, pleadings and evidence must be examined. Babli Rani recognises that a condition absent from the deed may still be alleged and proved. Clear drafting at the outset remains preferable. Paragraph 17.

Does having a pension or other assets prevent cancellation?

In the Bombay case, financial independence did not defeat the claim once Section 23’s conditions were satisfied. A claim for maintenance payments and a claim to set aside a conditional transfer need their respective legal requirements examined. Paragraph 13 of the judgment.
