A bounced cheque is important evidence—not automatic conviction

Section 138 ordinarily requires a cheque drawn for discharge, wholly or partly, of a legally enforceable debt or liability, dishonour, a compliant written demand, non-payment within the statutory window and a complaint filed before the competent court.

The signed cheque and statutory presumptions can be significant, but the transaction, enforceability, notice, service, limitation, jurisdiction and defence evidence still matter. “Security cheque” and “blank signed cheque” are not self-operating defences.

Within how many days must a cheque bounce notice be sent?

The written demand notice is ordinarily issued within 30 days from the date the payee or holder receives information from the bank regarding dishonour. Calculate from the bank information and documents, not merely from an informal message.

How long does the drawer have to pay after receiving notice?

The drawer ordinarily has 15 days from receipt of the compliant statutory notice to pay the cheque amount. The cause of action for the complaint ordinarily arises after non-payment within that period.

What is the time limit for filing a Section 138 complaint?

The complaint is ordinarily filed within one month from the date on which the cause of action arises under Section 138. Section 142 permits delayed cognizance where sufficient cause is shown, but delay should never be assumed to be condoned.

How long is a cheque valid in India?

Under current RBI directions, an ordinary cheque is generally valid for three months from its date. The instrument and current banking position should still be checked before presentation.

Can a security cheque result in a Section 138 case?

Yes, depending on the facts. Calling a cheque “security” does not by itself prevent Section 138. The court examines whether a legally enforceable liability had arisen when the cheque was presented, along with the agreement and transaction record.

The statutory demand must correctly demand the amount covered by the dishonoured cheque. A materially different amount can invalidate the notice. Additional interest or legal charges should be separately identifiable.

When can a cheque bounce complaint be filed in Gurgaon?

Can a cheque bounce case be settled or compounded?

Yes. Offences under the Negotiable Instruments Act are compoundable. Settlement terms should clearly state the payment schedule, default consequences and the court step for withdrawal or compounding.

Can civil recovery and a Section 138 case proceed together?

They are different remedies and may, where legally maintainable, be pursued in relation to the same underlying liability. Civil or commercial limitation, court fees, arbitration clauses and adjustment of amounts recovered require separate review.

Should a cheque bounce summons be ignored if settlement talks are continuing?

No. Settlement discussions do not automatically excuse court appearance or stop coercive process. The listed date, exemption or appearance requirement should be handled unless the court has passed an appropriate order.
