How your Will is drafted

Stage 01 — Instructions

Share family & distribution instructions

The testator’s basic particulars, family structure, intended beneficiaries, proposed executor and a brief summary of the assets.

Stage 02 — Documents

Share the relevant documents

Title documents, an existing Will, family arrangements or other records are reviewed to the extent required for accurate drafting.

Stage 03 — Drafting

Draft and revise

Property schedules, beneficiary instructions, executor provisions, revocation language and a residuary clause. The standard scope includes up to two revision rounds.

Stage 04 — Execution

Print, sign and attest

The final Will is printed and signed physically, with guidance on the testator’s signature, attesting witnesses and execution precautions.

No travel to Gurgaon is needed for drafting itself. Registration, if chosen, is a separate stage.
Counsel

Looking for the best Will lawyer in Delhi? Judge the drafting, not the description

A Will is only as strong as the ownership it correctly describes and the instructions it actually records. Choosing a Will lawyer in Delhi is therefore less about the title on a listing than about how carefully your family structure, title documents and intended distribution are examined before a single clause is drafted.

In short: the difference a Will lawyer makes in Delhi shows in four places — whether the property schedule matches the title, whether alternates are provided for, whether earlier Wills and nominations are reconciled, and whether execution under §63 is set up correctly. Advocate Sunita Tiwari settles each of these before a Delhi Will is signed.
Advocate Sunita Tiwari, Will drafting and review advocate for Delhi matters

Advocate Sunita Tiwari

Independent Enrolled Advocate Bar Enrolment No. P‑839A/2009

An independent enrolled advocate carrying Bar Enrolment No. P-839A/2009, Advocate Sunita Tiwari reads every Will against the client’s family structure, ownership documents, succession concerns and intended distribution before the first clause is drafted.

The work is not limited to placing information into a standard Will format. Each matter is treated as an individual legal and family arrangement requiring careful drafting, practical review and correct preparation for execution — and, where the testator chooses it, for registration.

01 · Judgment

The questions a Will format cannot ask you

A template records whatever is typed into it. The judgment lies in the questions put before anything is typed:

  • What happens if a beneficiary does not survive the testator?
  • Who takes that share if the primary beneficiary cannot inherit?
  • What if the appointed executor is unwilling or unable to act?
  • How should a minor beneficiary’s share be held, and until when?
  • Does the asset belong wholly to the testator, or only in part?
  • What happens to property acquired after the Will is signed?
  • Is the residuary clause wide enough to catch omitted assets?
  • Could any wording leave room for doubt between family members?

Settling these while the Will is being drafted is what removes ambiguity later — not adding length to the document.

02 · Method

Every matter is read before it is drafted

The proposed distribution is read against the ownership documents, the family position, applicable personal law and the executor arrangement, so the Will reflects both what the testator may lawfully give and what the testator actually intends.

  • The position is discussed before documents are collected unnecessarily
  • Scope and fee are stated before drafting begins
  • The property schedule is written from the title, not from a format
  • Alternates, residuary and revocation are addressed as standard
  • Up to two revision rounds within the standard drafting scope
  • The client reads and approves the final Will before signing

Questions, ambiguities and unintended consequences are therefore dealt with while they can still be corrected.

03 · Delhi Sub-Registrar stage

Registration, if you choose it, is prepared as a separate stage

Registration of a Will is optional under Section 18 of the Registration Act, 1908, and does not make a defective Will sound. Where a testator nevertheless decides to register, the preparation follows once the Will has been finalised:

  • Identity and document readiness for the testator
  • Witness selection and their identity documents
  • Review of the final printable Will before appearance
  • Confirmation of the Sub-Registrar office having jurisdiction
  • Appointment coordination for the appearance
  • Signing, acknowledgement and registration formalities
  • Collection and safe preservation of the registered Will

Drafting, legal review and registration preparation are handled as one coordinated sequence, instead of being approached separately at each stage.

Why clients instruct Advocate Sunita Tiwari

Clients looking for a Will lawyer in Delhi receive drafting combined with a practical understanding of what happens to the document afterwards. Each matter is assessed individually, the scope and fee are stated before work begins, future possibilities are discussed rather than left implied, and the client reads the final Will before it is signed.

Whether the requirement is a fresh Will, correction of an existing draft, an NRI or multi-property Will, or drafting together with registration preparation, the document is built around the actual family, the actual title and the actual intention.

A Will should not merely be ready for signature. It should be legally clear, practically workable, and capable of guiding your family when you are no longer available to explain it.

Discuss your Will with Advocate Sunita Tiwari

Mention whether a draft already exists, the type of Delhi property involved, and whether you need fresh drafting, a review, or drafting together with registration preparation.

Instructions and documents are received through this platform, which provides facilitation and documentation support and is not itself a law firm. Drafting and legal review are carried out by the advocate named above.

Clause II

What it costs, how long it takes, and what you actually have to do

Six things people want settled before they start. None of them requires a visit to an office.

In short: a Will attracts no stamp duty in Delhi, so there is no stamp paper to buy. Drafting is ₹1,999 to ₹6,999 depending on scope. Instructions, documents and revisions are handled remotely, and the only physical step is signing the printed Will in front of two witnesses.
I
There is no stamp paper to buy
A Will in Delhi attracts no stamp duty. It does not need to be written on stamp paper, and anyone selling you stamp paper for a Will is selling you something you do not need.
II
Nothing to visit, nothing to queue for
Your details, your documents and every revision are handled over WhatsApp or email. Drafting is completed without you travelling to Gurgaon or anywhere else.
III
First draft in 3 working days
You receive the draft to read in full, and the standard scope includes up to two rounds of changes before the Will is finalised for signature.
IV
Your two witnesses can be arranged easily
Any two adults who are not receiving anything under the Will — and who are not married to anyone receiving anything — can attest it. Neighbours, colleagues or friends are all suitable, and who to pick is explained to you.
V
What you receive at the end
A print-ready Will drafted to your instructions, together with written instructions on how it must be signed, who signs where, and what the witnesses have to do.
VI
What we need from you to begin
Your family details, a list of what you own, whatever title documents you have for the property, and the name of the person you want as executor. Anything missing can follow later.
Clause III

Most Delhi Wills are written for one of these eight reasons

People rarely arrive wanting a document. They arrive with a situation — a house that has to go to the right person, a child who will be treated differently from the others, or a family they would rather not leave arguing. If one of these is yours, the wording is what decides whether your intention survives you.

In short: a Will in Delhi should be drafted rather than filled into a format when the property is anything other than a cleanly, solely owned freehold — and whenever shares are unequal, an heir is being left out, there has been a second marriage, a beneficiary is a minor, or a beneficiary or executor lives outside India.
The eight reasons we are asked most often
  • 01You want the property divided between your children and settled now, so they are not left to fight over it.
  • 02You want to give one child more than another, or to leave someone out, and you want it to hold.
  • 03Your flat is a DDA leasehold, a CGHS society flat or a builder floor, and you are not sure how it should be described.
  • 04You have remarried, or there are children from an earlier marriage, and both sides need to be provided for.
  • 05A beneficiary is a minor, or is dependent, and someone reliable has to look after the share until they can.
  • 06A child, a beneficiary or the person you want as executor lives outside India.
  • 07You already have a draft or a downloaded format and want it checked before you sign it.
  • 08It simply needs to be done, and done soon, and you want it handled properly the first time.

Any one of these is reason enough to have the Will drafted rather than filled in. Tell us which one is yours and the scope, the fee and the next step can be confirmed in the same conversation.

Clause IV

Your Delhi property is one of these six — and each one is worded differently

This is where most Delhi Wills go wrong. Not in the language, but in what the testator believed they owned. Find your property below and you will see what has to be established before it can be left to anyone.

In short: you can only leave what you actually hold. A DDA flat may be leasehold rather than freehold, a CGHS flat is often held through a share certificate rather than a deed, a builder floor usually carries only a fraction of the land, and a jointly owned house can be willed only to the extent of your own share. Each of these has to be described from the document that created the title.
A DDA flat or plot
The first question is whether your interest is leasehold or freehold, because the two are not left in the same words. The allotment or conveyance papers settle it, along with the sector, pocket, block and flat or plot number.
A CGHS society flat
Many society flats are held through membership and a share certificate rather than a registered deed. What passes under the Will has to match what the society records actually show, or the beneficiary is left arguing with the society.
A builder floor
You usually own one floor plus an undivided share of the land, not the whole plot. Parking and terrace rights pass only as far as your documents actually grant them — claiming more in a Will creates the dispute rather than preventing it.
A jointly owned house
If the property is in two names, you can leave your share and not the whole house. A Will that gives away all of it invites an objection from the surviving co-owner, which is exactly what the Will was meant to prevent.
Property you inherited
What you may leave depends on how it came to you and on the law that applies to your family. That has to be established first, because inherited and ancestral property are not the same thing and are not dealt with in the same way.
A flat in Delhi, but you live abroad
You do not have to be in India to have the Will drafted. Where the Will is to be signed, where your other assets are, and whether your executor can act from where they live all need to be worked out in advance.
Naming a property in a Will does not create ownership of it. If the title is incomplete or disputed, that has to be dealt with separately — the Will cannot fix it.

Question 3Is the testator, executor or any beneficiary an NRI or outside India?

Answer the three questions to see which scope applies.

The above amounts are professional fees for the stated drafting or review scope. Registration, government fees, travel, courier, medical documentation and services outside the agreed scope are separate.

Clause VI

What a Will lawyer checks before your Will is finalised

I
Testamentary capacity & voluntariness
The testator must understand the nature of the Will, the property being dealt with and the effect of the distribution. Instructions must be voluntary and free from coercion.
II
Family and natural heirs
Spouse, children, parents and other heirs should be identified. A natural heir may be named even when no benefit is given, so omission is not mistaken for oversight.
III
Property ownership
A Will can deal only with the property or share lawfully belonging to the testator. Joint, inherited, ancestral, leasehold and society properties need careful description.
IV
Beneficiaries & alternates
Each bequest should identify the beneficiary and the asset or share. An alternate beneficiary can be named in case the primary does not survive the testator.
V
Executor & alternate executor
The executor implements the Will after death. The person chosen should be trustworthy and practically capable of dealing with property, institutions and beneficiaries.
VI
Minor or dependent beneficiaries
Where a beneficiary is a minor or needs continuing support, the Will may need guardian or management provisions and clear instructions on when control passes.
VII
Residuary estate
A residuary clause deals with property, refunds, investments or other assets not specifically listed, or acquired after the Will is made.
VIII
Earlier Wills & connected documents
Earlier Wills, codicils, nominations, family settlements and ownership documents should be disclosed so contradictory instructions are not unintentionally left in place.
Clause VII

When a sample Will format may not be sufficient

Legal review should be considered particularly where —

  • ◆one child is receiving more than another;
  • ◆a spouse, child or other natural heir is being excluded;
  • ◆the testator is elderly, unwell or dependent on a beneficiary;
  • ◆the person helping prepare the Will is also receiving a major benefit;
  • ◆property is jointly owned, inherited or ancestral;
  • ◆the testator has remarried or has a blended family;
  • ◆a beneficiary is a minor or has a disability;
  • ◆the executor or beneficiary lives outside India;
  • ◆an earlier registered or unregistered Will exists;
  • ◆nominations differ from the intended distribution; or
  • ◆the family is already experiencing a property dispute.

These circumstances do not automatically invalidate a Will. They require clearer drafting and more disciplined execution.

Will Format in Delhi: What a Legally Sound Will Should Contain

A sample Will format can help you understand the usual structure of a Will in Delhi. Before signing, the document should be adapted to the testator’s actual family, lawful ownership, beneficiaries, executor and intended distribution.

Essential clauses to check in a Delhi Will format
  • 01Testator’s declaration — full particulars, soundness of mind and voluntary intention.
  • 02Revocation clause — clear cancellation of earlier Wills and codicils.
  • 03Family particulars — spouse, children, parents and other relevant natural heirs.
  • 04Property and asset schedule — accurate descriptions based on ownership records.
  • 05Beneficiaries and shares — precise gifts, proportions and alternate beneficiaries.
  • 06Executor provisions — appointment of an executor and, where appropriate, an alternate.
  • 07Residuary clause — treatment of omitted, later-acquired or remaining assets.
  • 08Execution and attestation — the testator’s signature and attestation by two witnesses.

A format is a structure, not a substitute for ownership checking. If the property is DDA leasehold, CGHS society-held, a builder floor, jointly owned, or inherited, the schedule has to be rewritten against the title before the Will is signed.

Important: These editable samples are general reference formats, not execution-ready legal advice. A Will should be customised to the testator’s ownership documents, personal law, family circumstances and intended distribution before it is signed and witnessed.
Clause VIII

Signing and witnessing the Will

§Indian Succession Act, 1925 — Sections 59 & 63

Section 59. A person of sound mind who is not a minor may dispose of property by Will.

Section 63. For an ordinary unprivileged Will, the following are required:

  • the testator signs or affixes a mark, or another person signs in the testator’s presence and under the testator’s direction;
  • the signature shows an intention to give effect to the document as a Will;
  • attestation by at least two witnesses; and
  • each witness signs the Will in the presence of the testator.
Independent adult witnesses who are not beneficiaries — and not spouses of beneficiaries — should ordinarily be selected. This reduces avoidable disputes and prevents complications concerning a benefit given to an attesting witness.

Registration cannot correct an improperly signed or insufficiently attested Will.

Clause IX

Is Will registration compulsory in Delhi?

Optional§18 · 1908

No. Registration of a Will is optional under Section 18 of the Registration Act, 1908. A properly drafted and executed Will does not become invalid merely because it is unregistered.

Registration creates an official registration record, but it does not:

  • cure defective ownership;
  • replace proper attestation;
  • establish that every clause is legally effective; or
  • make the Will immune from challenge.

If registration is chosen, it is a separate stage after the Will has been finalised. The testator and both attesting witnesses appear in person before the Sub-Registrar having jurisdiction over the testator’s residence or the property.

Govt. registration fee₹500 + ₹100 pasting
The Delhi Revenue Department currently lists this fee for a Will. Appointment systems, office allocation and charges should be verified from the official Delhi Revenue portal at the time of registration.

Clause XII

Will drafting and Will lawyer questions in Delhi — answered

01How much does a Will drafting lawyer in Delhi charge?
Review of an existing editable Will is ₹1,999. A standard customised Will is ₹3,499. Complex, NRI, ancestral, business-related or multi-property Wills start from ₹6,999 after reviewing the circumstances. Registration and external expenses are separate.
02Can Will drafting services in Delhi be completed online?
Yes. Instructions, consultation, document review and revisions can be handled remotely, so an office visit is not generally required for drafting. The completed Will must nevertheless be physically signed and attested. Registration, if chosen, requires compliance with the applicable physical procedure.
03Can I prepare a Will for Delhi property while living elsewhere?
Yes. The drafting can cover Delhi property even when the testator currently lives elsewhere. Ownership documents, applicable personal law and the intended place and method of execution must be reviewed.
04Where is a Will registered in Delhi, and is registration necessary?
Registration is optional under Section 18 of the Registration Act, 1908. If chosen, the Will is presented at the office of the Sub-Registrar having jurisdiction over the testator’s residence or the property, with the testator and both attesting witnesses appearing in person. The Delhi Revenue Department currently lists a ₹500 registration fee with ₹100 pasting charges. A Will attracts no stamp duty.
05Can a registered Will be challenged?
Yes. Registration does not prevent objections based on fraud, coercion, lack of capacity, suspicious circumstances, defective execution or absence of ownership. Good drafting and disciplined execution remain essential.
06Can a parent give unequal shares to children?
A testator may generally make unequal or specific bequests to the extent the property is lawfully disposable under the applicable law. The nature of ownership, applicable personal law and the treatment of natural heirs should be reviewed and expressed clearly.
07Can ancestral or jointly owned property be included?
Only the interest or share legally available to the testator should be included. A Will cannot give a beneficiary a larger right than the testator possesses.
08Can a beneficiary act as a witness?
A beneficiary or the beneficiary’s spouse should not ordinarily be used as an attesting witness. Independent witnesses are the safer choice.
09Is a medical certificate compulsory for an elderly testator?
It is not a universal statutory requirement for every elderly person. Contemporaneous medical-capacity documentation may nevertheless be advisable where age, illness, dependency or surrounding family circumstances could lead to a future challenge.
10Can an NRI engage a Will lawyer for assets in Delhi?
Yes. Drafting and review can be conducted remotely. Execution outside India, foreign assets, tax or probate implications and the practical availability of the executor may require additional review.
11Is a free Will maker enough, or should a lawyer prepare the Will?
An automated Will maker produces a draft from whatever is typed into it. It cannot check whether the testator actually owns what is being bequeathed — which is where DDA leasehold, CGHS share certificates, builder-floor land shares and jointly held property most often break a Delhi Will. Where ownership is anything other than a clean, solely held freehold title, or where a natural heir is being excluded, a minor benefits, an earlier Will exists or a beneficiary is abroad, the document should be drafted or reviewed by a lawyer before it is signed.
